Solanum melongena (Eggplant) is a medicinal plant belonging to the family Solanaceae. This study aimed to perform a comparative assessment of the methanol extracts of the fruit and the leaf of Solanum melongena against multi-drug-resistant Staphylococcus aureus and Pseudomonas aeruginosa. The crude extracts were obtained from the leaves and fruits of the plant using methanol. The plant extracts were tested for the presence of various phytochemical constituents qualitatively. The antibacterial assay and minimum inhibitory concentration for the crude extracts were carried (...) out using the agar well diffusion and agar dilution methods, respectively. Phytochemical analysis of methanol extracts of Solanum melongena revealed the presence of various phytoconstituents. Antibacterial assay of methanol extracts of Staphylococcus melongena against multi-drug-resistant Staphylococcus aureus isolates with ciprofloxacin as a reference control revealed inhibition zone diameter ranging from 04.0±0.0 to 11.0±0.0 mm; in contrast that of multi-drug-resistant Pseudomonas aeruginosa isolates revealed inhibition zone diameter, with ciprofloxacin showing no inhibition. The minimum inhibitory concentration of the methanol extracts on Pseudomonas aeruginosa isolates ranges from 25.0 to 50.0 mg/ml and 25.0->50.0 mg/ml, respectively, in comparison, the minimum inhibitory concentration of the methanol extracts on Staphylococcus aureus isolates ranges from 6.25 to 50.0 mg/ml and 6.25->50.0 mg/ml respectively. Thus, the fruit extract had better activity against test multi-drug-resistant Pseudomonas aeruginosa and Staphylococcus aureus than the leaf extract of Solanum melongena. (shrink)

It seems like we care about at least two features of our credence function: gradational-accuracy and verisimilitude. Accuracy-first epistemology requires that we care about one feature of our credence function: gradational-accuracy. So if you want to be a verisimilitude-valuing accuracy-firster, you must be able to think of the value of verisimilitude as somehow built into the value of gradational-accuracy. Can this be done? The aim of this paper is to apply the accuracy based approach to epistemology to the case of higher order evidence: evidence that bears on the rationality of one's beliefs. I proceed in two stages. First, I show that the accuracy based framework that is standardly used to motivate rational requirements supports steadfastness—a position according to which higher order evidence should have no impact on one's doxastic attitudes towards first order propositions. The argument for this will require a generalization of (...) an important result by Greaves and Wallace for the claim that conditionalization maximizes expected accuracy. The generalization I provide will, among other things, allow us to apply the result to cases of self-locating evidence. In the second stage, I develop an alternative framework. Very roughly, what distinguishes the traditional approach from the alternative one is that, on the traditional picture, we're interested in evaluating the expected accuracy of conforming to an update procedure. On the alternative picture that I develop, instead of considering how good an update procedure is as a plan to conform to, we consider how good it is as a plan to make. I show how, given the use of strictly proper scoring rules, the alternative picture vindicates calibrationism: a view according to which higher order evidence should have a significant impact on our beliefs. I conclude with some thoughts about why higher order evidence poses a serious challenge for standard ways of thinking about rationality. (shrink)

I aim to offer a practical response to skepticism. I begin by surveying a family of responses to skepticism that I term “dogmatic” and argue that they are problematically evasive; they do not address what I take to be a question that is central to many skeptics: Why am I justified in maintaining some beliefs that fail to meet ordinary standards of doxastic evaluation? I then turn to a discussion of these standards of evaluation and to the different kinds of (...) doxastic value to which they appeal. While there is something good about having a true belief and something bad about having a false one, I argue the value of true beliefs is not intrinsic or final. Truth and knowledge are valuable because they contribute to both individual and collective flourishing. But if contributing to flourishing is what ultimately provides truth with its value, then we have discovered another doxastic value. I call this kind of doxastic value “practical.” The practical response addresses the skeptic’s question by claiming that some beliefs can be justified by appealing to their practical, rather than alethic, value. In fleshing out this practical response I contrast it both with dogmatic responses as well as some seemingly similar “practical” alternatives, namely Crispin Wright’s appeals to entitlements and Susanna Rinard’s “pragmatic skepticism.” I end by addressing some objections. The study investigated the effect of cognitive restructuring on junior secondary school mathematics test anxiety in Oshimili south L.G.A of Delta State. Two research questions and two hypotheses tested at 0.05 level of significance guided the study. Quasi-experimental research design was adopted for this study. The population for this study was a total of 1224 students. These comprised of all the JSS 2 students from Oshimili South Local Government Area of Delta State. Research sample consisted of 120 JSS 2 students (...) with high level of mathematics test anxiety selected through purposive sampling technique. The instrument adopted for this study was Maths anxiety rating scale-R. Data collected from the study were analyzed using mean and ANCOVA. Results obtained from the study indicated that Cognitive restructuring therapy (CRT) was effective on mathematics test anxiety of junior secondary school students. The results equally showed that Cognitive restructuring therapy was more effective on the female students’ mathematics anxiety than their male counterparts. Furthermore, the results indicated a significant difference in the post-test mathematics test anxiety mean scores of students treated with CRT and those in the control group. Also, there was significant difference in the post-test mathematics test anxiety mean scores of male and female students treated with CRT. Based on the findings of this study, some recommendations were noted. The researcher recommended, among others that Schools’ Guidance Counselors should be empowered to make good use of the cognitive restructuring technique, in counseling students who find it difficult to comprehend mathematics skills. Řadí mezi ně úsilí o dosažení božské přízně, nesmrtelnosti, vyššího společenského postavení, ale i ideálů kalokagathia, areté a dalších ctností. Důležitý rozměr antického sportu spatřuje rovněž v jeho formativním potenciálu směřujícímu k přípravě na duševní život. (...) Cílem textu je identifikovat a vyzdvihnout výchovný smysl sportování, poukázat na jeho filosofické konotace a možnou roli sportu v otázce vedení dobrého života. ----------- This manuscript deals with the problematics of ancient Greek sport, specifically with the significance of sporting practices and their educational role. Attention is given to a detailed analysis of the positions of the philosophers Socrates, Plato, and Aristotle. After demonstrating the context, the author presents and interprets fundamental philosophical and religious premises of the athletic performance and its educational role. Among the identified features are the effort of acquiring divine favour, immortality, higher social status, but also the ideals of kalokagathia, areté, and other virtues. Important dimension of ancient Greek sport is also found in its formative potential which aims at the preparation for intellectual life. The main part of the article is focused on the approaches of the philosophers Socrates, Plato, and Aristotle towards the sporting practices. These thinkers made an important contribution to the understanding of the educational role of sport. Then, the author identifies a good sport according to these thinkers and examines the role of such sport in the context of a good life, which is considered in the Aristotelian perspective as achieving beatitude (eudaimonia). The aim of this article is to identify and highlight an educational purpose of sport, underlines its philosophical connotations, and demonstrate its possible role in the context of a good life. The scope of the sexual abuse of minors’ crises within the Catholic Church examined in conjunction with the purpose of temporal goods, the responsibility of the episcopate, the meaning of good stewardship, the faithful’s obligation to financially support the church, and compensation to alleged victims and their attorneys presents a realistic quandary for the Christifideles. -/- Should the Church replete with its perceived “deep pockets” be “selling off” temporal goods to remunerate lawsuits, which in some situations far exceed those of (...) other “institutions?” Should there be limits? Moreover, one ought to also contemplate whether there is a difference in the “handling” or disposition of sexual abuse cases involving minors when the competent authority has knowingly increased the risk of financial liability to the faithful. What should happen? This brief analysis seeks to examine the above questions as they apply to dioceses in the U.S. and its territories. Inquiry concerning canon 1254, inter alia in the 1983 Code of Canon Law may allow insight vis-à-vis the connotation of “temporal goods,” their application, and relevancy to restitution regarding the sexual abuse of minors. -/- . Podle vývojové interpretace Platónových dialogů to naznačuje posun v autorově myšlení způsobený poznáním obtížnosti problému. Byl to přitom údajně teprve Aristotelés, kdo vyřešil Platónův problém dobra pomocí pojmu analogie. Proti této interpretaci článek zdůrazňuje, že aristotelské pojetí analogie je hluboce zakořeněno v Platónově vlastním potýkání se s rozdílem mezi morálním a politickým (...) dobrem. With the release of Laudato Si (2015) Pope Francis has introduced new conceptual language into Catholic social teaching (CST), what he has called "integral ecology." His intent appears to be grounded in the realization that "It is essential to seek comprehensive solutions which consider the interactions with natural systems themselves and with social systems" (LS, no. CXXXVIII). Pope Francis goes on to make the case that ''We are faced not with two separate crises, one environmental and the other social, but (...) rather with one complex crisis with isboth social and environmental" (LS, no. CXXXVIII). Consequently, in order to solve this crisis we need to utilize "an integrated approach to combating poverty, restoring dignity to the excluded, and at the same time pro­ tecting nature" (LS, no. CXXXVlll). This perspective represents a major development in CST whereby the encyclical connects the dots between ecology/environment, economics and society, three essential aspects of what many in the environmental community and elsewhere see as in­ dispensable for humanity to achieve a sustainable relationship with the Earth. While this is extremely important for articulating a Catholic vision of sustainability, that is not the direction we take in this article. Rather our intent is to use the concept of integral ecology to do three things:(1) examine a current case in the U.S. that has received signif­ icant media attention as well as notoriety-the water crisis in Flint, Michigan; (2) describe how our recent understanding of the epigenetic impacts of environmental toxins casts a new and ominous light on this crisis and on other instances of environmental toxin exposure, and (3) propose some ideas on how epigenetic research might enlarge our in­ terpretation of basic aspects of CST highlighted in Laudato Si such as human dignity, justice and the common good. Filmmaking with Artificial Intelligence Image Generation Models In just about one year, OpenAI’s release of ChatGPT 4 has caused panic in our daily lives. After a year, OpenAI introduced Sora, a moving image-generating model from text, similar to DALL-E for still images. Even though Sora is not yet available to the public, the very potential itself has raised issues in film production from the perspectives of producers and studios, as well as directors, actors, writers, and editors. In this chapter, the (...) role and expected impact of AI video generation technologies, such as OpenAI Sora and Stable Diffusion 3, will be considered in regard to filmmaking. To discuss these issues, it is necessary to further analyze the concept of artificial intelligence, what it means, and how it is misunderstood by the general public. These misunderstandings also lead to sci-fi fantasy and doomsday talk, adding nothing valuable to the debate. Once this concept is defined, the argument of why an artificial general intelligence akin to a human being is unlikely will be set, mostly referring to Hubert Dreyfus and David Chalmers. However, even though the good old-fashioned AI seems impossible, the AI tools we have now seem to be enough to cause many of the problems that the thought of a complete artificial intelligence also brings forth. It is important to treat these tools as tools and not entities in their current forms to focus on the more practical problems regarding human labor, interaction, and experience in the world. In this regard, it is important to look back in history to see how technology has shifted ways of making films. When thought of as such, it becomes clearer that these tools will likely not end human involvement in the practice of creating art but transform the methods and aesthetics of film production, challenging conventions in both artistic and commercial works in some ways and exaggerating them in others. Furthermore, the chapter will consist of the investigation of the impact of various AI tools on human creativity. Regarding human creativity, commercial films will most likely go through a paradigm shift. Production companies will most likely regard this shift as a way of improving performance and production. However, this advancement poses dire questions in the field and pursuit of creating art. AI tools help automate and accelerate the filmmaking process at the cost of filmmaking as an art form. The discussion will address why commercial filmmaking will see a paradigm shift and loss of some human labor, but in an optimistic world of philosophical thought, film as fine art will gain much in return. This is because AI tools in their current and foreseeable state are not capable of willing to make art due to their limitations regarding embodied cognition, experience, unconsciousness, and intuition. These things make us what we are more than we think. There is no better way to explain why human beings make art than to show how tools do not matter but the ideas and the will to do it. -/- . According to the standard interpretation of Lewis’s theory of predicate meaning (the U&N theory), the naturalness of meaning candidates should be stated metaphysically - as a length of definition in terms of fundamental properties. Recently, Weatherson has criticized the U&N theory and argued that the criterion of naturalness should be stated epistemologically - as the amount of evidence needed to form a belief. Despite the criticism, his attitude towards the U&N theory is quite relaxed. According to Weatherson, the U&N theory (...) can be used as a good heuristic for delivering the correct verdicts when doing applied semantics, i.e., when we try to determine the best meaning candidate for a particular predicate. In this paper, I try to show that the “good heuristic strategy” is of no use because A) there is no guarantee that the epistemological and the metaphysical criteria of naturalness deliver the same verdicts and B) even if they deliver the same verdicts, the difference in their theoretical backgrounds may affect arguments which rely on the verdicts. The difference will be shown by drawing on the example of Theodore Sider and his use of the U&N theory. (shrink)

The paper discusses three aspects of belonging to religious systems of belief within a modern liberal society, namely (1) the sincerity and consistency of belief, (2) the possibility of exteriorization of belief through broader social interactions or transactions, and (3) the relationship between religious belief and the modern concept of affirmative tolerance, or affirmation of differences, which has become a pronounced public policy in multicultural liberal societies. The author argues that, while negative tolerance allows sincere religious belief to flourish in (...) the private sphere and for benevolence to be shown to those who are seen as mistaken in their beliefs, affirmative tolerance opens an array of logical issues. The demand to extend potential substantive validation to opposed beliefs produces the ricochet effect of de-validating one’s own beliefs. This creates difficulties for religious communities when issues at stake are beliefs that, in the respective belief-systems, are definitive of the moral goodness and moral badness. Upon a more careful examination of the logical relations between the soteriological promises characteristic of what is sometimes called the ‘substantive’ layer of religiousness, on the one hand, and the public expectation of a tolerant coexistence of religious communities on a social level, on the other hand, it becomes clear that the tolerance required can only be a negative tolerance. Any expectation of affirmative tolerance de-values the soteriological script of the respective system of religious belief, and is thus likely to lead to serious disturbances in a liberal context of multi-cultural coexistence. The author argues that the recent political announcements of a ‘failure of the multicultural experiment’ are caused by the aggressive pursuit of ‘affirmative tolerance’ rather than by any in-built intolerance of others in any of the large religious belief systems now prevalent in the liberal democratic world. The paper compares Comenius’ usage of the terms unum, verum and bonum in his metaphysical writings both with the expression of the image of the Trinity in De civitate dei by Aurelius Augustinus and with the concept of existence as three basic movements in the philosophical work of Jan Patočka. The purpose of the text is to show, despite the differences in historical periods, language and life experience, the possible similarity or connection of the vision that Augustine, Comenius and Patočka (...) mediate in their works. The purpose of this paper is to demonstrate how Bertrand Russell depicts the relation of mysticism to three other areas of human activity: philosophy, science, and religion, and thus: its special role. In his essay Mysticism and Logic (1914), Russell defines mystical thinking as beliefs in (1) the existence of special insight, (2) the unity of all things, (3) the unreality of time, and (4) the effacement of the boundaries between good and evil. Although he considers full mysticism – as (...) a belief about the ontic structure of the world – to be erroneous – as a life attitude he attributes to it an element of wisdom that is lacking in other areas of human intellectual activity. Mysticism proves wrong also at the epistemological level, i.e. as a certain test of truth. But in its spirit of inquiry, it contains something that science also benefits from, and from which, therefore, scientific philosophy should take its cue. What additionally gives mysticism its value is the claim of impartial contemplation which gives rise to an attitude of love towards the whole world. Significantly, it was the combination of the best features of mystical thinking with scientific thinking and method which gave rise to Russell’s advocacy of scientific philosophy. In light of this, I argue that according to Russell mysticism is not an exclusively religious phenomenon, which is demonstrated, among other things, by the fact that he attributes two aspects of mysticism to the field of mathematics. Education for Empire: American Schools, Race, and the Paths of Good Citizenship (Stratton, 2016) is much more than a history book about American education. It is a critical work that provides philosophical undertones that challenge our perception about the imperial roles of the U.S. school system. Stratton very clearly and meticulously presents the intricate relationship between history, civics, and geography within school curricula and textbooks. He shows us how these subjects have been manipulated by those in power to promote a (...) hidden agenda. One that instills national pride, American loyalty, and patriotism, and is designed to turn students into supporters of U.S. imperialism and of their racial and class hierarchies. An example of this is Stratton’s own examination of the content of books like, Complete Geography written in 1899. Stratton claims this text was widely used in American public schools and it explicitly states that, “the Caucasian or white race is most intelligent and most powerful of all races.” Education for Empire: American Schools, Race, and the Paths of Good Citizenship helps us understand why it has taken so much time for people of color, like me, to occupy academic spaces and to begin the dismantling of oppressive governmental and pedagogical systems that have intentionally kept us from having a dignified education. This paper argues that private property and rights assignment, especially as applied to communication infrastructure and information, should be informed by advances in both technology and our understanding of psychology. Current law in this area in the United States and many other jurisdictions is founded on assumptions about human behavior that have been shown not to hold empirically. A joint recognition of this fact, together with an understanding of what new technologies make possible, leads one to question basic assumptions about (...) how law is made and what laws we should have in a given area, if any. I begin by analyzing different aspects of U.S. law, from a high-level critique of law making to a critique of rights assignment for what I call 'simple nonrival goods.' I describe my understanding, as a non-lawyer with a background in psychology and computing, of the current conventions in U.S. law, consider the foundational assumptions that justify current conventions, describe advances in psychology and technology that call these conventions into question, and briefly note how the law might normatively change in this light. I then apply this general analysis to the question of domain name assignment by the Internet Corporation for Assigned Names and Numbers (ICANN). (shrink)

Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. This analytical study explores the nature of scientific progress connected to current philosophical definitions and the role of institutional governance in promoting this progress. This paper examines how public and private initiatives intersect to create a wartime level of scientific progress during peacetime, as promoted in detail by Vannevar Bush, Director of the Office of Scientific Research and Development (OSRD) from 1941-47. This study suggests that the public benefit from the war footing approach to scientific progress should outweigh the losses (...) to the public good that accumulate due to wartime restrictions on scientific discourse during times of peace. The interaction and dependence of scientific progress on military development, public health and public needs in general, the tax code and the patent system form the foundation of Bush’s program for sustaining wartime levels of scientific progress during peacetime. This study references the COVID-19 period and the solutions that were applied to emergent public needs through scientific programs. Justice of the United States (U.S.) Supreme Court Neil Gorsuch noted in May 2023 that “…we may have experienced the greatest intrusions on civil liberties in the peacetime history of this country.” This study proposes that the dilution of scientific truth in public policy is the result of a collective institutional mindset among scientists. This mindset endorses public programs that provide society with a wartime risk response in peacetime. In this study, from an epistemological standpoint and considering the work of other researchers in this field, these developments in scientific progress will be analyzed. (shrink)

Definition of the problem: The connection between time and the good life has already been worked out for a number of medical specialties and practices. However, what role does the temporality of the good life play for medicine as a whole? That is the central question of this article. Arguments: The good life is here understood as a meaningful life. Living meaningfully is only possible through present action. A fulfilled presence in this sense is therefore an essential aspect of the (...) temporality of the good life. Illness tends to prevent a fulfilled presence. In this respect, medical treatments aim to enable a fulfilled presence. A second structure of time, that is central to the good life, consists in the chronobiological rhythms, upon the maintenance and restoration of which health is critically dependent. Conclusion: The temporality of the good life has a twofold relevance for medicine as a whole. First, the purpose of medical treatment is to enable a fulfilled present. Second, this can and should be done by maintaining and restoring chronobiological rhythms. ++++ Der Zusammenhang von Zeit und gutem Leben wurde bereits für eine Reihe medizinischer Disziplinen und Praktiken herausgearbeitet. Doch welche Rolle spielt die Zeitlichkeit des guten Lebens für die Medizin insgesamt? Das ist die leitende Frage dieses Artikels. Dabei wird das gute Leben als sinnvolles Leben verstanden. In diesem Sinne wird für eine zweifache medizinische Relevanz der Zeitlichkeit des guten Lebens argumentiert: Erstens besteht der Sinn medizinischer Behandlungen in der Ermöglichung erfüllter Gegenwart. The contribution focuses on philosophical issues of justice of positive law in the light of the social teaching of John Paul II. The analyses start with consideration of anthropological foundations of justice as virtue, develop with the reflexion upon justice of actions realizing justice and finally arrive at examination of the criteria of justice of law. -/- It is argued that relations between a human being and goods (ends of actions) form ontological basis of natural law and justice of actions (...) – orders and prohibitions are secondary in respect to these relations. An aim of just law (and natural law) is not preservation or restoration of abstractly understood moral order based on norms – orders and prohibitions) but integral development (good) of a person – a being possessing dignity. John Paul’s II philosophy of law takes advantage primarily of Thomas Aquinas’ approach to law and combines it with constructions which are typical for modern human rights protection. John Paul’s II conception of natural law is anthropocentric and bases on subjective rights thinking. Human dignity and human rights which derive from it provide basic criteria for the justice of law. Human rights as subjective rights disclose natural law which is understood as a set of goods for a human person. These goods are ends of actions and as such they determine actions and their forms. This point of view is compatible with Aquinas’ definition: “law is nothing but a rational plan of operation, and … the rational plan of any kind of work is derived from the end” (Summa contra gentiles, lib. 3, cap. 114, n. 5). -/- Positive (human) law which is not just has no normative power in this sense that it does not in itself provide reasons for concrete actions of a concrete actor. Sometimes there are moral reasons for following unjust law, however if its norm prescribes actions which are wrong in themselves (internally wrong) there is moral obligation to act contrary to such a legal norm. -/- Zasadniczym przedmiotem opracowania jest filozoficzna refleksja Jana Pawła II nad sprawiedliwością prawa stanowionego. Opracowanie zamykają uwagi wskazujące na kontekst teologiczny istotny dla problematyki sprawiedliwości, którego analiza wykracza jednak poza podjęte zamierzenie koncentrujące się na problematyce filozoficznoprawnej. Argumentuje się, że u podstaw tej refleksji leży namysł nad relacją człowieka do dobra, która stanowi ontologiczną podstawę prawa naturalnego i sprawiedliwości – nakazy i zakazy są wtórne wobec tej relacji. Celem prawa i sprawiedliwości jest dobro konkretnego, obdarzonego godnością człowieka, a nie np. przywracanie abstrakcyjnie pojętego porządku moralnego. Od strony konstrukcji teoretycznej, filozofia prawa Jana Pawła II jest osadzona przede wszystkim na koncepcji Tomasza z Akwinu łączonej z konstrukcjami typowymi dla współczesnej ochrony praw człowieka. To w godności i wynikających z niej prawach człowieka poszukiwać trzeba zasadniczych treściowych kryteriów sprawiedliwości prawa. Prawa człowieka jako prawa podmiotowe są podstawowym wyrazem prawa naturalnego, stanowiącego ontyczną podstawę sprawiedliwości i które pojmowane jest jako zespół dóbr dla osoby, zatem i celów kształtujących działanie. Perspektywa pojmowania prawa naturalnego jest antropocentryczna. Prawo stanowione, które nie jest sprawiedliwe, nie ma „mocy prawa”, przede wszystkim w takim sensie, że nie stanowi samo w sobie racji działania. Niekiedy, ze względów moralnych, niesprawiedliwe prawo wymaga posłuszeństwa. Jeśli jednak prawo stanowione daje uprawnienia do czynów wewnętrznie złych i nakazuje takie czyny, to nie tylko nie obowiązuje w sumieniu i nie jest racją działania, ale obowiązkiem jest postępowanie wbrew takiemu prawu. Neoliberalism is an approach to social policy, now globally influential, that applies market approaches to all aspects of social life, including education. Charter schools, privately operated but publicly funded, are its most prominent manifestation in the U.S. The neoliberal principles of competition, consumerism, and choice cannot serve as foundations of a sound and equitable public education system. Neoliberalism embraces socio-economic inequality overall and in doing so constricts any justice mission its adherents espouse in virtue of serving a relatively disadvantaged student (...) population, as charter schools often (by no means always) do. It constricts educational justice by (1) embracing a “human capital” approach as the primary good of education, (2) creating educational inequality through (unofficially) selecting a relatively advantaged segment of the disadvantaged demographic it serves, (3) denying the effect of poverty on educational performance, and (4) devaluing its students’ familial ethnic cultures. In response to our critics, we clarify and defend key ideas in the report Open and Inclusive: Fair Processes for Financing Universal Health Coverage. First, we argue that procedural fairness has greater value than Dan Hausman allows. Second, we argue that the Report aligns with John Kinuthia’s view that a knowledgeable public and a capable civil society, alongside good facilitation, are important for effective public deliberation. Moreover, we agree with Kinuthia that the Report’s framework for procedural fairness applies not merely (...) within the health sector, but also to the wider budget process. Third, we argue that while Dheepa Rajan and Benjamin Rouffy-Ly are right that robust processes for equal participation are often central to a fair process, sometimes improvements in other aspects of procedural fairness, such as transparency, can take priority over strengthening participation. Fourth, while we welcome Sara Bennett and Maria Merritt’s fascinating use of the Report’s principles of procedural fairness to assess the U.S. President’s Emergency Plan for AIDS Relief, we argue that their application of the Report’s principle of equality to development partners’ decision-making requires further justification. Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. Increased participation in public affairs by the U.S. Conference of Catholic Bishops during the highly contentious 2012 Presidential election has seemingly brought the traditions of Catholic social teaching and socialism into a high profile conflict. While it is clear that President Obama is not what most academics would consider a “socialist,” modern discourse still presents what I argue is a false dichotomy- one can be either endorse natural law (especially of the Catholic variety) or socialism, but not both. While my (...) goal in this article is to refute the alleged incompatibility, not to determine its historical roots, some speculation about its origin may be illuminating. Recent work on religious identity in the United States suggests that Americans largely identify Christianity with the right wing of the American culture war. Additional research is required to fully grasp where this perception comes from, but one can venture several guesses: the rise of the “Christian Right” in Republican Party politics of the late 1990s and early 2000s, the concept of “social justice” being lampooned by Right-wing talk show hosts, and decades of a Catholic Church that firmly opposed Cold War-era Soviet Communism. The contrast between left-wing and right-wing thought on social issues (same-sex marriage, abortion, etc.) is very well documented and widely discussed. Differences between leftists and natural lawyers on economic issues, however, are more often assumed than argued for. Perhaps this is a matter of “guilt by association,” with those arguing that leftist social policy is at odds with natural law simply assuming that the same must be the case with leftist economic policy as well. Thus, natural law, long tied to Christianity throughout its history, is gratuitously appropriated by right-wing political ideology. Against this claim of incompatibility, I argue that one can rationally hold both socialism and natural law to be true. In his landmark Natural Law and Natural Rights, John Finnis offers what is arguably the twentieth century’s most complete theory of natural law. I will argue that the conception of socialism laid out by G.A. Cohen in hisWhy Not Socialism? is compatible with Finnis’s account of the human goods, and that natural lawyers can therefore reasonably endorse Cohen’s prescription for socialism. (shrink)

Opracowanie zmierza do określenia paradygmatu rozumienia klauzuli dobra wspólnego zawartej w art. 1 Konstytucji z 1997 r. i treści sformułowanej w nim zasady. Argumentuje się, że – m. in. ze względu na zachowanie materialnej tożsamości konstytucji – kluczowa dla realizacji postawionego celu jest analiza prac przygotowawczych. Analiza ta pozwala na postawienie tezy, że dobro wspólne to – określana na płaszczyźnie wspólnoty politycznej – suma warunków życia społecznego umożliwiających i ułatwiających rozwój wszystkich członków tej wspólnoty i tworzonych przez nich społeczności. Szeroko (...) przedstawiona jest szersza, sięgająca starożytności, filozoficzna tradycja ideowa leżąca u podstaw identyfikowanego paradygmatu konstytucyjnego pojęcia dobra wspólnego, oraz polskie tradycje konstytucyjne powiązane z podjętą problematyką. Argumentuje się, że ustrojodawca wskazał określoną tradycję ideową jako wyznaczającą podstawowy kontekst wyznaczający rozumienie klauzuli dobra wspólnego oraz wprost zdystansował się wobec centralnych elementów ujęcia dobra wspólnego właściwego konstytucji kwietniowej z 1935 r., pozostając w tradycji, do której należała Konstytucja 3 Maja. Sformułowana w art. 1 Konstytucji z 1997 r. zasada dobra wspólnego głosząca, że „Rzeczpospolita Polska jest dobrem wspólnym wszystkich obywateli”, sytuuje dobro wspólne u podstaw całego porządku konstytucyjnego. Po zidentyfikowaniu zasadniczych elementów tej zasady argumentuje się, że jest ona zasadą pierwszą, strukturalnie powiązaną z każdym elementem systemu prawnego. Argumentuje się na rzecz tezy o integralnym powiązaniu dobra wspólnego z godnością i uznaniu wolności i praw człowieka za zasadniczy element dobra wspólnego. Opracowana koncepcja zostaje zaaplikowana do orzecznictwa Trybunału Konstytucyjnego. Przeprowadzona analiza wskazuje, że orzecznictwo to nie jest, jak dotąd, oparte na spójnej koncepcji dobra wspólnego. Nierzadko przyjmowana jest perspektywa typowa dla – odrzuconego przez ustrojodawcę – ujęcia w duchu konstytucji kwietniowej, w której dobro wspólne przeciwstawiane jest prawom człowieka; obecne są jednak także elementy typowe dla ujęcia klasycznego, w duchu Konstytucji 3 Maja. Analizę dopełniają postulaty dotyczące dalszego kształtowania orzecznictwa TK odwołującego się do dobra wspólnego. (shrink)

The mind-brain identity theory, the thesis that sensations are identical with properties or processes of the brain, was introduced into contemporary discussion by U.T. Place, Herbert Feigl, and J.J.C Smart in the 1950s. Despite its widespread rejection in the following decades, the identity theory has received several carefully articulated defenses in recent years. Aside from developing novel responses to well-known arguments against the identity theory, contemporary identity theorists have argued that the epistemological resources available to support the adoption of identities (...) are more plentiful than has often been supposed; further, they have argued that mind-brain identities allow for the resolution of otherwise intractable explanatory puzzles about the phenomenal properties of experience. From an epistemological perspective, identity theorists have thus argued that a central reason for believing theoretical identities—both mind-brain identities as well as more mundane identities such as water = H2O—stems from the explanatory power that they confer. Yet from an explanatory perspective, identity theorists have maintained that identities cannot themselves be explained; indeed, they have maintained that it is hardly intelligible to request an explanation for an identity. This paper considers these ideas draws out an important tension between them. The central claim is that insofar as identity theorists insist on the explanatorily efficacy of identities, they should concede that there is a good sense in which theoretical identities can be explained. However, it is moreover argued that this concession is not especially problematic and, indeed, ought to be welcomed by identity theorists. (shrink)

Linden Lab studies massive online game "Second Life" unexpectedly gained worldwide fame after a few years after release. To the surprise of many game has met with great interest, despite the lack of promotional campaigns. It can be assumed that the reason why "second life" reached a wider audience was a special type of offered entertainment. Network game proved to be no longer a game that was known so far, but an example of a mass media, whose central element is (...) a dynamic virtual world which is an extension of our "first" reality. "Second Life" has the potential, which is challenging the widely shared rules could shake the foundations of the social world. This program is currently the most advanced example of a virtual economy. Unlike many other massive online games and their predecessors, this game is entirely based on the principles of virtual property ownership, as well as rules of conduct virtual business and service, and finally also the consumption of goods. Users of the game, just like the person providing the data in the framework of social networking sites maintained in the mainstream of Web 2.0, user-generated content constituting the virtual world, which can trade content with others linden virtual dolars that can be exchanged to real U.S. dollars. The increase in popularity of "Second Life" brings to mind the vision of the possibility of creating a better place to live for many people. This paper aims at an analytical explanation of the distinctive nature of music, as it has been formulated in perhaps one of the world's very first works on the subject, namely the ‘Sangeet Ratnakar’ of Pandit Sarangadeva, a 13th century musicologist of India. He, in the first chapter of the work defines music ('sangeet' in Sanskrit and Hindi) as a composite of singing or 'Gita', instrumental music or 'vadan' and dancing or ‘nrittam’. In addition, he also holds singing to be (...) the most important component of music. These two ideas are not only unquestionably acceptable , as the analysis in the paper will show, but give to Indian music , in its difference from western music, its distinctively spiritual character, making it a path to liberation or Moksha (Muktidayakam na tu ranjakam). Sarangadeva's reason, here, is not rational but empirico-inductive. It is that mainly by virtue of its 'gitam’ (singing component), which, like the Yoga system of exercise, needing only one's body as its instrument, music too needing only one’s voice is as self-sufficient and autonomous as the ultimate Reality itself (Swayamev Rajate). In the hierarchy (a distinctively ancient Indian insistence) of arts, singing is the highest and unique because in spite of being heard by the auditory sense, it affects our 'reflective sensibility' and transports us to the virtual world of melodic and rhythmic forms. Forms, as against their particular illustrations, are abstract universals. Ultimate Reality is also a Form-all comprehensive and internally harmonious. However, pure Form, whether melodic or religious or even rational like that of triangularity, is almost impossible to concentrate on. Realizing this practical difficulty, Indian scriptures and the world's first Grammarian-linguist, Acharya Panini, framed a composite sound as the manifestation of the ultimate musical Form. This purely formal-because devoid of all meaning, sound is that of 'om', spelt, in Sanskrit as a conjunction (sandhi) of 'a'+'u'+'m'. For Indian musicologists and musicians, ‘om’ is the perfect manifestation of the Sound-God or ‘Nada-Brahman’ because, 1. Its composite nature resembles God, as a harmony of 'sat', 'chit', and 'ananda'; and 2. The composite sound is self-existent as its all three components-two vowels, i.e. ‘a’, ‘u’, and one consonant i.e. ‘m’, can be and are pronounced just as they originally are, -un-elongated and un-vitiated and therefore pure. This is the reason why every recital of Indian classical vocal music is begun with an elaborate rendering of 'om' as an invocation to Sound-God or ‘Nada-Brahman’. Scholarly and authentic, this ancient Indian approach to music, is undoubtedly the earliest and original. My observation is that its main contentions like Sharang Dev’s insistence that of the three components of music, ‘gitam’ or singing is the highest, have only been translated and never argued for. In this presentation my good intention is to provide much needed rational support for making these key statements in this unparalleled Indian text, indubitable and unquestionable. (shrink)

In this paper, I aim to do three things. First, I introduce the distinction between the Uniqueness Thesis (U) and what I call the Conditional Uniqueness Thesis (U*). Second, I argue that despite their official advertisements, some prominent uniquers effectively defend U* rather than U. Third, some influential considerations that have been raised by the opponents of U misfire if they are interpreted as against U*. The moral is that an appreciation of the distinction between U and U* helps to (...) clarify the contours of the uniqueness debate and to avoid a good deal of talking past each other. (shrink)

Imagine both that (1) S1 is deliberating at t about whether or not to x at t' and that (2) although S1’s x-ing at t' would not itself have good consequences, good consequences would ensue if both S1 x's at t' and S2 y's at t", where S1 may or may not be identical to S2 and where t < t' ≤ t". In this paper, I consider how consequentialists should treat S2 and the possibility that S2 will y at (...) t". At one end of the spectrum, consequentialists would hold that, in deciding whether or not to x at t', S1 should always treat S2 as a force of nature over which she has no control and, thus, treat the possibility that S2 will y at t" as she would the possibility that a hurricane will take a certain path. On this view, S1 is to predict whether or not S2 will y and act accordingly. At the other end of the spectrum, consequentialists would hold that S1 should always treat S2 as someone available for mutual cooperation and, thus, treat the possibility that S2 will y at t" as something to be relied upon. On this view, S1 is to rely on S2’s cooperation and so play her part in the best cooperative scheme involving the two of them. A third and intermediate position would be to hold that whether S1 should treat S2 as a force of nature or as someone available for mutual cooperation depends on whether S1 can see to it that S2 will y at t" by, say, having the right set attitudes. I’ll argue for this third position. As we’ll see, an important implication of this view is that consequentialists should be concerned not just with an agent’s voluntary actions but also with their involuntary acquisitions of various mental attitudes, such as beliefs, desires, and intentions. Indeed, I will argue that consequentialists should hold both that (1) an agent’s most fundamental duty is to have all those attitudes that she has decisive reason to have and only those attitudes that she has sufficient reason to have and that (2) she has a derivative duty to perform an act x if and only if her fulfilling this fundamental duty ensures that she x’s. Thus, I argue (as Donald Regan did before me) that consequentialism should not be exclusively act-orientated – that it should require agents not only to perform certain voluntary actions but also to have certain attitudes. In the process, I develop a new version of consequentialism, which I call attitude-consequentialism. Abstract: In Vacco v. Quill, 521 U.S. 793 (1997), the Supreme Court for the first time in American case law explicitly applied the principle of double effect to reject an equal protection claim to physician-assisted suicide. Double effect, traced historically to Thomas Aquinas, proposes that under certain circumstances it is permissible unintentionally to cause foreseen evil effects that would not be permissible to cause intentionally. The court rejected the constitutional claim on the basis of a distinction marked out by the (...) principle, i.e., between directly intending the death of a terminally ill patient as opposed to merely foreseeing that death as a consequence of medical treatment. The Court held that the distinction comports with fundamental legal principles of causation and intent. Id. at 802. -/- Critics allege that the principle itself is intrinsically flawed and that, in any event, its employment in Vacco is without legal precedent. I argue in response to contemporary objections that double effect is a valid principle of ethical reflection (Part II); claims to the contrary notwithstanding, double effect analysis is a pervasive, albeit generally unacknowledged principle employed regularly in American case law (Part III); and drawing on the preceding two sections, Vacco's application of the principle of double effect is appropriate (Part IV). -/- My conclusion is that [o]peration of some form of the principle, by whatever name, is inevitable. In an imperfect world where duties and interests collide, the possibility of choices of action foreseen to have both good and evil consequences cannot be avoided. In rare circumstances, ethics and the law require that a person refrain from acting altogether. RESUMO A inseminação artificial (IA) é a biotecnologia mais empregada com vantagens superiores em relação a utilização da monta natural, cuja eficácia se dá na larga escala de reprodução entre os bovinos. Associando essa biotécnica com hormônios pode-se estabelecer manipulações do sistema reprodutivo da fêmea, levando a manejos de inúmeras cabeças de gado para inseminar a um tempo fixo. Portanto, foram realizados 5 protocolos de IATF, tendo 2 categorias de animais: nulíparas e multíparas. No protocolo 1 foram submetidas 81 multíparas, (...) resultando em 47 animais prenhes; No protocolo 2 foram protocoladas 103 animais multíparas, no qual resultou em 51 prenhes; já o protocolo 5 foram submetidas 77 animais multíparas, no qual resultou em 36 animais prenhes. Cada serviço realizado foi matematicamente calculado, sendo o ponto de partida o escore corporal, bem estar animal e a técnica bem exercida. Desta forma obteve bons resultados na (IATF) , no qual destaca-se o percentual : o protocolo 1 obteve 58,02%, o protocolo 2 obteve 49,51% na taxa de prenhez, No protocolo 3 obteve 55,67% na taxa de prenhez, o protocolo 4 obteve 53,33% de prenhes, já o protocolo 5 resultou em 46,75% de prenhez. O uso das biotecnologias da reprodução, realizadas em bovinos de corte, obteve resultado dentro do descrito pela literatura consultada. A boa taxa de prenhes apresentada na IATF deveu-se ao bom controle hormonal do ciclo estral e da qualidade do sêmen utilizado. A taxa de prenhez dos animais que foram submetidos à monta natural foi baixa pelo fato de que os reprodutores não conseguiram cobrir todas as fêmeas. ABSTRACT The artificial insemination (AI) is the most used biotechnology with superior advantages in relation to the use of natural mounting, whose effectiveness is given in the large scale of reproduction among cattle. Associating this biotechnique with hormones it is possible to establish manipulations of the reproductive system of the female, leading to managements of numerous heads of cattle to inseminate at a fixed time. Therefore, 5 IATF protocols were performed, having 2 categories of animals: nulliparous and multiparous. In protocol 1, 81 multiparous animals were submitted, resulting in 47 pregnant animals; in protocol 2, 103 multiparous animals were submitted, resulting in 51 pregnancies; and in protocol 5, 77 multiparous animals were submitted, resulting in 36 pregnant animals. Each service performed was mathematically calculated, with the starting point being the body score, animal welfare and the well exercised technique. Thus obtained good results in the (IATF), which highlights the percentage: protocol 1 obtained 58.02%, protocol 2 obtained 49.51% in pregnancy rate, in protocol 3 obtained 55.67% in pregnancy rate, protocol 4 obtained 53.33% pregnant, and protocol 5 resulted in 46.75% pregnant. The use of the reproduction biotechnologies, performed in beef cattle, obtained results within the described by the consulted literature. The good pregnancy rate presented in the IATF was due to the good hormonal control of the estrous cycle and the quality of the semen used. The pregnancy rate of animals that were subjected to natural mating was low due to the fact that the sires could not cover all the females. Keywords: Hormones. Cattle Pregnancy Rate. President Bush and his Council of Economic Advisors have claimed that the U.S. shouldn’t adopt a national health program because doing so would slow innovation in health care. Some have attacked this argument by challenging its moral claim that innovativeness is a good ground for choosing between health care systems. This reply is misguided. If we want to refute the argument from innovation, we have to undercut the premise that seems least controversial -- the premise that our current system produces (...) more innovation than a national health program would. I argue that this premise is false. The argument requires clarifying the concept ‘national health program’ and examining various theories of human well-being. (shrink)

Sometimes constitutions fail. The unprecedented election of Donald Trump, a populist insurgent who lacks the prior political experience or military service of all presidents before him, is such a sharp break in American historical experience that it raises questions as to whether something is deeply amiss with the constitutional order. Constitutional failure is not uncommon. A path-breaking global study of national constitutions shows that on average, they last only nineteen years. The U.S. Constitution is an uncommon outlier and, as such, (...) is accounted by many a long-running success story. But could a bell be tolling for American constitutionalism? In this Essay, I assess the meaning of Trump’s shocking rise for the future of our constitutional order. The shock, of course, was not the election of a Republican president. There have been many Republican presidents since Lincoln, each making their own distinctive contribution to the American tradition. Yet, there are good reasons to think this time around is different. The efficacy and, perhaps, stability of our constitutional order are in question, and we should try to understand why. (shrink)

Critical thinking (CT) in the Philippine basic education curriculum may be said to be clearly evident in the inclusion of “Trends, Networks and Critical Thinking in the 21st Century”. The course is required in the senior high school HUMSS track. CT in Philippine education is likely based or patterned upon U.S.’s “teaching for thinking” program. In Lipman’s survey (2003), the program transitioned to “teaching for critical thinking.” The Philippines was a U.S. colony from 1898 to 1946. This historical and yet (...) colonial reason for teaching CT appears mitigated by a seeming universal recognition of the necessity for teaching critical thinking in schools in every culture. Such recognition appears clear, for example, in Noddings (2016). Despite the existence of such a reason, however, there appears a need to supplement it with ones other than from the perspective of the west. The perspective referred to is that of Confucian ethics. Confucian ethics gives attention to good, sound reasoning (Lai 2006), which suggests an emphasis on CT. Given that, Confucian ethics likely promotes teaching of CT. The proposal here is that in the consideration of reasons or views for teaching CT in the country, a non-western point of view, that of Confucian ethics, be given a hearing. (shrink)

Lawyers and judges cannot adequately address the nature of text, meaning, or interpretation without reference to the insights provided by linguists and philosophers of language. Exploring some of those insights, this article focuses upon what linguists and philosophers of language call “pragmatics.” Pragmatics examines the relations between words and users rather than the relations of words to words (syntax) or the relations of words to the world (semantics). In other words, pragmatics studies how language users actually use and interpret words (...) and other signs in communication. -/- Pragmatics recognizes that speaker meaning can differ from (and even contradict) linguistic meaning, including the literal meaning of text. In its proper context, for example, “Bob is indeed a good lawyer” can ironically mean just the opposite. Pragmatics also recognizes that relevant text is not a thing-in-itself that is simply given. Good lawyers look at such things as purpose and cohesion when determining relevant text. They do not simply take their opponent’s (or even their client’s) assertions of relevance. -/- Pragmatics also provides lawyers with a number of specific concepts and tools which are helpful in determining speaker meaning. For user convenience, this article attempts to set out in one place a number of such concepts and tools. These include: (1) types of cohesion that help determine relevant text, (2) types of context that help determine meaning, (3) pragmatic principles of construction such as principles of relevance and politeness, and (4) important pragmatic notions or devices such as anaphora, cataphora, ellipsis, deixis, presupposition, unstated premises, entailment, and implementives. -/- Finally, as a recurring example (among others) of pragmatics in action, this article examines from multiple perspectives textual issues raised in King v. In this paper, I begin by defending permissivism: the claim that, sometimes, there is more than one way to rationally respond to a given body of evidence. Then I argue that, if we accept permissivism, certain worries that arise as a result of learning that our beliefs were caused by the communities we grew up in, the schools we went to, or other irrelevant influences dissipate. The basic strategy is as follows: First, I try to pinpoint what makes irrelevant influences (...) worrying and I come up with two candidate principles. I then argue that one principle should be rejected because it is inconsistent with permissivism. The principle we should accept implies that it is sometimes rational to maintain our beliefs, even upon learning that they were caused by irrelevant influences. (shrink)

Greaves and Wallace argue that conditionalization maximizes expected accuracy. In this paper I show that their result only applies to a restricted range of cases. I then show that the update procedure that maximizes expected accuracy in general is one in which, upon learning P, we conditionalize, not on P, but on the proposition that we learned P. After proving this result, I provide further generalizations and show that much of the accuracy-first epistemology program is committed to KK-like iteration principles (...) and to the existence of a class of propositions that rational agents will be certain of if and only if they are true. Responding to an article in a previous issue from Matthew B. O’Brien on the impermissibility of same-sex marriage, this reply corrects a misinterpretation of Rawls’s understanding of political liberalism and a misdirected complaint against the jurisprudence of the U.S. federal courts on civil marriage and other matters. In correcting these interpretations, I seek to demonstrate that a publicly reasonable case for same-sex civil marriage is conceivable in line with political liberalism. I conclude the article by arguing that, although the same-sex (...) civil marriage issue is likely to be a matter of controversy for some time in western societies, a proper understanding of the theoretical issues at stake may contribute to a partial de-escalation of the ‘culture wars’ currently surrounding the issue. The Queen's College, Oxford, UK In his article `Facts and Principles', G.A. Cohen attempts to refute constructivist approaches to justification by showing that, contrary to what their proponents claim, fundamental normative principles are fact- in sensitive. We argue that Cohen's `fact-insensitivity thesis' does not provide a successful refutation of constructivism because it pertains to an area of meta-ethics which differs from the one tackled by constructivists. While Cohen's thesis concerns the logical structure of normative principles, constructivists ask how normative principles (...) should be justified . In particular, their claim that justified fundamental normative principles are fact-sensitive follows from a commitment to agnosticism about the existence of objective moral facts. We therefore conclude that, in order to refute constructivism, Cohen would have to address questions of justification, and take a stand on those long-standing meta-ethical debates about the ontological status of moral notions (for example, realism versus anti-realism) with respect to which he himself wants to remain agnostic. It has been claimed that, in response to certain kinds of evidence, agents ought to adopt imprecise credences: doxastic states that are represented by sets of credence functions rather than single ones. In this paper I argue that, given some plausible constraints on accuracy measures, accuracy-centered epistemologists must reject the requirement to adopt imprecise credences. I then show that even the claim that imprecise credences are permitted is problematic for accuracy-centered epistemology. It follows that if imprecise credal states are permitted (...) or required in the cases that their defenders appeal to, then the requirements of rationality can outstrip what would be warranted by an interest in accuracy. The assumption that positive affect leads to a better performance in simple cognitive tasks has become well established. We address the question whether positive and negative emotions differentially influence performance in complex problem-solving in the same way. Emotions were induced by positive or negative feedback in 74 participants who had to manage a computer-simulated complex problem-solving scenario. Results show that overall scenario performance is not affected, but positive and negative emotions elicit distinguishable problem-solving strategies: Participants with negative emotions are more (...) focused on the seeking and use of information. We discuss methodological requirements for investigating emotion influences in complex and dynamic cognitive tasks. (shrink)

This paper is about the connection between rationality and accuracy. I show that one natural picture about how rationality and accuracy are connected emerges if we assume that rational agents are rationally omniscient. I then develop an alternative picture that allows us to relax this assumption, in order to accommodate certain views about higher order evidence.

In recent years, permissivism—the claim that a body of evidence can rationalize more than one response—has enjoyed somewhat of a revival. But it is once again being threatened, this time by a host of new and interesting arguments that, at their core, are challenging the permissivist to explain why rationality matters. A version of the challenge that I am especially interested in is this: if permissivism is true, why should we expect the rational credences to be more accurate than the (...) irrational ones? My aim is to turn this challenge on its head and argue that, actually, those who deny permissivism will have a harder time responding to such a challenge than those who accept it. (shrink)

My main aim is to argue that most conceptions of doxastic agency do not respond to the skeptic’s challenge. I begin by considering some reasons for thinking that we are not doxastic agents. I then turn to a discussion of those who try to make sense of doxastic agency by appeal to belief’s reasons-responsive nature. What they end up calling agency is not robust enough to satisfy the challenge posed by the skeptics. To satisfy the skeptic, one needs to make (...) sense of the possibility of believing for nonevidential reasons. While this has been seen as an untenable view for both skeptics and anti-skeptics, I conclude by suggesting it is a position that has been too hastily dismissed. (shrink)

This paper takes a new look at an old question: what is the human self? It offers a proposal for theorizing the self from an enactive perspective as an autonomous system that is constituted through interpersonal relations. It addresses a prevalent issue in the philosophy of cognitive science: the body-social problem. Embodied and social approaches to cognitive identity are in mutual tension. On the one hand, embodied cognitive science risks a new form of methodological individualism, implying a dichotomy not between (...) the outside world of objects and the brain-bound individual but rather between body-bound individuals and the outside social world. On the other hand, approaches that emphasize the constitutive relevance of social interaction processes for cognitive identity run the risk of losing the individual in the interaction dynamics and of downplaying the role of embodiment. This paper adopts a middle way and outlines an enactive approach to individuation that is neither individualistic nor disembodied but integrates both approaches. Elaborating on Jonas’ notion of needful freedom it outlines an enactive proposal to understanding the self as co-generated in interactions and relations with others. I argue that the human self is a social existence that is organized in terms of a back and forth between social distinction and participation processes. On this view, the body, rather than being identical with the social self, becomes its mediator. (shrink)
